Amendment C170

Amendment Status: Approval under consideration

Melton City Council has prepared amendment C170 to the Melton Planning Scheme.

The amendment proposes to implement the findings of the Development Plan Overlay Review January 2019(PDF, 10MB)  which is that 8 of Council’s 16 existing DPO Schedules be removed either partially or in their entirety as they are no longer an appropriate planning control, given the development that has occurred.

The DPO Schedules affected by the amendment are:

  • Development Plan Overlay – Schedule 13 Ravenhall Freeway Business Park (DPO13)
  • Development Plan Overlay – Schedule 15 Western Highway Restricted Retail Site (DPO15)

Amendment C218

Amendment status: Gazetted

The Minister for Planning has now approved Amendment C218 to the Melton Planning Scheme.

The Exhibition period was from 7 July to 10 August 2020. Council adopted the amendment at an ordinary Council meeting held on 14 September 2020.

This amendment changed planning controls to allow for the storage of potable (drinkable) water at 1665A Mount Cottrell Road, Mount Cottrell, instead of the previously permitted storage of recycled water. The amendment also extended the time to commence and complete works, as well as update redundant planning controls.

Specifically, this amendment:

  • Amends the existing Incorporated Document ‘Mount Cottrell Class A Recycled Water Storage Facility’, March 2015, specifically to remove the reference to recycled water and extend the expiry date to allow greater time for the commencement of use and development;
  • Deletes the Public Acquisition Overlay Schedule 9 (PAO9) from the land;
  • Amends the Schedule to Clause 45.01 Public Acquisition Overlay to remove reference to PAO9 Western Water Corporation – Recycled Water Storage Facility;
  • Amends Planning Scheme Maps 13 and 12 PAO to remove reference to PAO9;
  • Introduces the Specific Controls Overlay to the Melton Planning Scheme;
  • Applies the Specific Controls Overlay to the land to replace the provisions currently contained under Clause 51.01 Specific Sites and Exclusions.
  • Amends the Schedule to the Specific Controls Overlay to identify the ‘Mount Cottrell Water Storage Facility’, February 2020 Incorporated Document;
  • Amends the Schedule to Clause 51.01 Specific Sites and Exclusions to delete reference to land at 1665 Mount Cottrell Road, Mount Cottrell (Lot 3 on Plan of Subdivision LP141929) Mount Cottrell Class A Recycled Water Storage Facility, Incorporated Document March 2015;
  • Amends the Schedule to Clause 51.01 Specific Sites and Exclusions to delete reference to land at 1665 Mount Cottrell Road, Mount Cottrell (Lot 3 on Plan of Subdivision LP141928) Water for a Growing West Project Incorporated Document, July 2014 as this does not apply to the land.
  • Amends Schedule to Clause 72.03 What does this planning scheme consist of?;
  • Amends the title of the Incorporated Document included in the Schedule to Clause 72.04 Documents Incorporated in this Planning Scheme;

The amendment was authorised for exhibition under Section 20(2) of the Planning and Environment Act 1987 requiring limited notification to adjoining landowners and referral authorities only.

The planning authority must make a copy of every submission available on its website for any person to inspect free of charge for two months after the amendment(s) comes into operation or lapses.

Amendment Status: Gazetted

The Amendment implements the findings of the City of Melton Heritage Assessments Project 2018, and adds the following nine places to the Schedule to the Heritage Overlay and the associated Heritage Overlay mapping.

The amendment was required to protect nine heritage places within the urban growth boundary that are deemed to be the heritage places most at-risk of being lost due to development pressure. Including these places in the Schedule to the Heritage Overlay, and incorporating the statements of significance formally recognises the heritage value of the properties, and the impact that proposed development may have upon them, should Council receive any development proposals for the subject properties.

The Heritage Overlay ensures that a planning permit is required for demolition and a range of buildings and works to ensure the heritage significance is protected. Any proposal will then be able to be assessed by council having regard to the purpose and decision guidelines of the Heritage Overlay and council’s local heritage policy contained at Clause 22.01 of the Melton Planning Scheme.

In particular the amendment:

1. Amends the Schedule to Clause 43.01 to rearrange the current heritage places in numerical order.

2. Amends the Schedule to Clause 43.01 to include the following heritage places on a permanent basis as follows:

  • HO129 at 398-428 Exford Road, Weir Views
  • HO130 at 430-458 Exford Road, Weir Views
  • HO131 2-98 Staughton Street, Melton South
  • HO132 at 325 Clarkes Road, Brookfield
  • HO133 at 2A Sherwin Court and 2 Killarney Drive, Melton
  • HO134 at 660A Beattys Road, Bonnie Brook
  • HO135 at 1267-1289 Beattys Road, Grangefields
  • HO136 at 660A Beattys Road, Bonnie Brook

Amendment status: Approval Under Consideration

The Amendment proposes to implement the recommendations of the City of Melton Electronic Gaming Planning Policy Project Reference Document, June 2017 in order to guide the location of electronic gaming machines in the municipality.

In particular, the Amendment:

  • Inserts a new Local Planning Policy for Electronic Gaming into the Melton Planning Scheme at Clause 22.13, including the City of Melton Responsible Gambling Policy, October 2014 and the City of Melton Electronic Gaming Planning Policy Project Reference Document, June 2017 as reference documents.
  • Amends the Particular Provisions at Clause 52.28, Schedule to Clause 52.28 Gaming.

Amendment C190

Amendment status: Gazetted

Amendment C190 corrects a number of existing anomalies regarding zoning and overlays that have been identified in the Melton Planning Scheme. The anomalies include mapping inaccuracies, zoning errors or zones no longer required, and incorrectly listed or mapped places from the Schedule to the Heritage Overlay. 

Correcting the anomalies within the Melton Planning Scheme ensures that the zoning reflects the use, and ownership of the land. Incorrect zoning can impact on the ongoing use of land, and in particular trigger the need for a planning permit where one would not normally be required.

In particular, the Amendment:

  • Rezones 7 Council owned properties that are zoned for an incorrect public use. The rezoning will ensure that zone correctly reflects that the land is owned by Council.
  • Rezones state government owned land to be consistent with the remainder of the parcel and to accurately reflect its intended future use.
  • Rezones 6 privately owned properties that are inappropriately zoned for public use. This will correct errors and apply the correct zone that is consistent with the remainder of the owners’ land, as well as surrounding properties.
  • Rezone two allotments owned by Western Water due to mapping boundary related errors.
  • Remove 2 overlays and amend 1 in relation to Heritage Overlay corrections.
