Amendment Status: Exhibition

Melton City Council has prepared amendment C170 to the Melton Planning Scheme.

The amendment proposes to implement the findings of the Development Plan Overlay Review January 2019(PDF, 10MB)  which is that 8 of Council’s 16 existing DPO Schedules be removed either partially or in their entirety as they are no longer an appropriate planning control, given the development that has occurred.

The DPO Schedules affected by the amendment are:

To identify whether your address is affected by this amendment you can access the search portal which allows you to search a property and identify whether your address is covered by a Development Plan Overlay Schedule which is being removed.

Additionally, there is further information on this amendment on the City of Melton Conversations website.

You may also inspect the amendment, any documents that support the amendment and the explanatory report about the amendment, at the Department of Environment, Land, Water and Planning (DELWP) website after 25 February 2021.

Any person who may be affected by the amendment may make a submission to the planning authority about the amendment. Submissions must be made in writing giving the submitter’s name and contact address, clearly stating the grounds on which the amendment is supported or opposed and what changes (if any) the submitter wishes to make. Name and contact details of submitters are required for council to consider submissions and to notify such persons of the opportunity to attend council meetings and any public hearing held to consider submissions. Council Meeting or Public Hearings may be either in person or via electronic means, subject to COVID-19 restrictions. 

The closing date for submissions is Wednesday 7 April 2021.

Submissions are part of an open public process undertaken in accordance with the Planning and Environment Act 1987 where all parties affected by the planning scheme amendment can provide input. If you choose to make a submission, you consent to your submission being made public, and being identified as the author of the submission. Submissions will be made available for public inspection at Melton City Council and online until two months after final approval of the planning scheme amendment.

A submission must be sent to the Manager City Design and Strategy, Melton City Council, PO Box 21, Melton 3337,  via email: citysupport@melton.vic.gov.au or online.

The amendment will not be available to view at Melton or Caroline Springs Civic Centres or Libraries. This is due to the implementation of the COVID-19 Omnibus (Emergency Measures) Bill 2020 which exempts any folders of information on amendments required from being provided at Council offices during this current time.

Adoption

The amendment was adopted by Council at its Ordinary Meeting on 8 February 2021 (see item 12.14).

The Amendment has been lodged with the Department Environment, Land, Water and Planning seeking approval from the Minister of Planning.

Melton City Council has prepared amendment C198 to the Melton Planning Scheme. Council exhibited the amendment C198 between 12 March – 1 May 2020 and for a second time from 18 June – 21 July 2020 as the Victorian State of Emergency COVID-19 restrictions, imposed during the previous exhibition period, may have impacted the ability for people to view amendment materials or make a submission.

The amendment proposes to implement the findings of the City of Melton Heritage Assessments Project 2018 by adding nine places to the Schedule to the Heritage Overlay and the associated Heritage Overlay mapping.

Amendment status: Approval under consideration

Public exhibition of this amendment has now concluded. The Exhibition period was conducted from 7 July to 10 August 2020. Council has now adopted this amendment at an ordinary Council meeting held on 14 September 2020. Final approval of this amendment will now be considered by the Department of Environment, Land, Water and Planning (DELWP).

This amendment proposes to change existing planning controls to allow for the storage of potable (drinkable) water at 1665A Mount Cottrell Road, Mount Cottrell, instead of the currently permitted recycled water storage. The amendment will also extend the time to commence and complete works, as well as update redundant planning controls.

Specifically, this amendment seeks to:

  • Amend the existing Incorporated Document ‘Mount Cottrell Class A Recycled Water Storage Facility’, March 2015, specifically to remove the reference to recycled water and extend the expiry date to allow greater time for the commencement of use and development;
  • Delete the Public Acquisition Overlay Schedule 9 (PAO9) from the land;
  •  Amend the Schedule to Clause 45.01 Public Acquisition Overlay to remove reference to PAO9 Western Water Corporation – Recycled Water Storage Facility;
  •  Amend Planning Scheme Maps 13 and 12 PAO to remove reference to PAO9;
  •  Introduce the Specific Controls Overlay to the Melton Planning Scheme;
  •  Apply the Specific Controls Overlay to the land to replace the provisions currently contained under Clause 51.01 Specific Sites and Exclusions.
  •  Amend the Schedule to the Specific Controls Overlay to identify the ‘Mount Cottrell Water Storage Facility’, February 2020 Incorporated Document;
  •  Amend the Schedule to Clause 51.01 Specific Sites and Exclusions to delete reference to land at 1665 Mount Cottrell Road, Mount Cottrell (Lot 3 on Plan of Subdivision LP141929) Mount Cottrell Class A Recycled Water Storage Facility, Incorporated Document March 2015;
  •  Amend the Schedule to Clause 51.01 Specific Sites and Exclusions to delete reference to land at 1665 Mount Cottrell Road, Mount Cottrell (Lot 3 on Plan of Subdivision LP141928) Water for a Growing West Project Incorporated Document, July 2014 as this does not apply to the land.
  •  Amend Schedule to Clause 72.03 What does this planning scheme consist of?;
  •  Amend the title of the Incorporated Document included in the Schedule to Clause 72.04 Documents Incorporated in this Planning Scheme;

The amendment was authorised for exhibition under Section 20(2) of the Planning and Environment Act 1987 requiring limited notification to adjoining landowners and referral authorities only.

Amendment status: Approval Under Consideration

The Amendment proposes to implement the recommendations of the City of Melton Electronic Gaming Planning Policy Project Reference Document, June 2017 in order to guide the location of electronic gaming machines in the municipality.

In particular, the Amendment:

  • Inserts a new Local Planning Policy for Electronic Gaming into the Melton Planning Scheme at Clause 22.13, including the City of Melton Responsible Gambling Policy, October 2014 and the City of Melton Electronic Gaming Planning Policy Project Reference Document, June 2017 as reference documents.
  • Amends the Particular Provisions at Clause 52.28, Schedule to Clause 52.28 Gaming.
