Local Law Permits
Melton City Council’s General Local Law allows Council to regulate activities within the community. When assessing permit applications, Council will consider the impact on community safety, health and amenity of the community.

Please note: applications will not be processed unless the application fee payment is received (if applicable) together with the completed form and required documentation. The application fee is non-refundable if the permit is cancelled or rejected.

Animals
Council’s General Local Laws Act (Part 6, Clause 81) requires a property owner or occupier to obtain a permit if they are seeking to house:
(A) equal to or less than 4,000 square metre area more than 2 Dogs and/or 2 Cats and/or 20 Large Birds and/or Small Birds and/or 12 Poultry and/or 5 Rodents and/or 5 Reptiles, or
(B) greater than 4,000 but less than 20,000 square metres in area more than 5 Dogs and/or 5 Cats.

Bulk Waste / Skip Bins
Council’s General Local Laws 2015 (Part 7, Clause 97) requires a person to obtain a permit if they are seeking to place a bulk waste bin (roadside skip bin) on a road or on Council land, including the nature strip. The bulk waste bin company is responsible for obtaining the permit.
If you wish to obtain a permit, the application will be through Service Victoria and will then be provided to Council for processing. Permit conditions include restrictions around the following:
- Placement of the skip bin
- Obstructing or obscuring views
- Size of the bin
- Damage caused by the placement of the bin
- Visibility of the bin
- Contents of the bin
- Responsibilities of permit holders
Making an application
- Payment of a non-refundable application fee applies
- A permit must be obtained prior to the bin placement
- You must hold public liability insurance with a minimum of $20 million to receive a permit and must contain the Obligation to Insure clause
- The application process will only take 10 minutes
- Upon completion, immediate approval will be sent via email

Caravan
Council’s General Local Laws 2015 (Part 5, Clause 57) requires a property owner or occupier to obtain a permit if they are seeking to camp on land, for a period exceeding 24 continuous hours, conditions apply.
Please note, this does not apply to storage of a Caravan on private land.
Permit applications will be considered based on the following:
- Written consent from the property owner
- Placement of the caravan
- Number of people who will occupy the caravan
- Caravan dimensions
- How sewerage or sullage will be disposed of
- How garbage must be disposed of
- Service connection
Making an application
- Payment of a non-refundable application fee is required
- All applications must be submitted 4 weeks prior to permit requirement, noting a consultation period is required with adjoining Property Owners or Occupants
- Approved permits are valid for 12 months from date of issue
- If the application is for placement on Council land, you must hold Public Liability Insurance with a minimum of $20 million that has a Principles Indemnity Clause to receive a permit
- Please note, depending on the caravan sewerage disposal requirements, we may refer the application to our Environmental Health team for additional review

Community Event Signage
Council’s General Local Laws 2015 (Part 3, Clause 28) requires a not-for-profit organisation to obtain a permit.
There are 15 community event signage locations on Council land within the City of Melton. Community Event means an event run by an organisation that is not for profit and is a legal entity, and where entry is free and the event proceeds are returned directly to the community.
All Community Event Signage permit applications need to be submitted at least 10 business days prior to the placement date. Community event signage may only be erected for a maximum of 28 days.

Making an application
- No Application fee is applicable
- An authorised officer of Council must be satisfied that the community event is of a cultural, social or recreational nature and should encourage a high level of community participation
- You must hold public liability insurance with a minimum of $20 million to receive a permit and must contain the Obligation to Insure clause
- An authorised officer of Council will allocate the final placement and location of signs (a maximum of three signs)
- The applicant will be contacted by an authorised officer of Melton City Council and be advised whether approval is granted or denied.

Fitness and Personal Training
Sporting clubs, schools, other clubs and community groups, including Personal Trainers are able to hire a recreation reserve or sporting venue for all types of events.

Footpath / Outdoor Trading
Council’s General Local Laws 2015 (Part 8, Clause 28) requires a business to obtain a permit if you want to:
- Place tables and chairs on Council land for the use of alfresco dining
- Put up an A-frame, flags, bunting or other signage for your business
- Sell or display goods on the footpath or nature strip outside your business
If you wish to obtain a permit, the application will be through Service Victoria and will then be provided to Council for processing. Permit conditions include restrictions around the following:
- Use of the Trading zone
- Obstructing access or obscuring views
- Waste/litter generated from the activity
- Placement of tables, chairs, A-frame signs, stands, umbrellas, etc.
- Securing of outdoor furniture and items
- Removal of outdoor furniture and items at conclusion of each business day
Please note, If you wish to permanently affix items on Council land or footpath, you will need to contact the Planning team on 9747 7200.
Making an application
- Melton City Council have waived footpath trading fees for the current financial year, however you will still require a permit
- To proceed with a permit application, you will need to know the width of your footpath. If it's less than 2.5m you will need to contact locallawsadmin@melton.vic.gov.au
- A permit must be obtained prior to the placement of any outdoor furniture and items
- You must hold public liability insurance with a minimum of $20 million to receive a permit and must contain the Obligation to Insure clause
- If you intend to trade in front of another business, a Footpath Trading Neighbouring Business Consent Letter(DOCX, 14KB) is required. You and your neighbour will need to complete and upload this form as part of the permit application
- If your business is selling food, you must have a food business registration
- Upon completion, immediate approval will be sent via email.

Fundraising
Council’s General Local Laws 2015 (Part 4, Clause 46,47,48,49) manages and facilitates responsible trading and entertainment on roads, road related areas and council land or in a public place for any fundraising activities.
You will require a permit if you are a registered charitable organisation or group and want to:
- conduct a highway, door knock or street collection on Council land
- conduct a raffle on council land
- conduct a Sausage Sizzle or other similar activity on Council land
Permit conditions may include restrictions around the following:
- Public safety
- Identification of staff
- Location of the activity and placement of materials
- Disposal of waste/litter from the activity
Making an application
- No Application fee is applicable
- All Fundraising permit applications need to be submitted at least 10 business days prior to commencement of activity
- You must hold Public Liability Insurance with a minimum of $20 million that has a Principles Indemnity Clause to receive a permit
- All Sausage Sizzle Permit applications require a Class 4 Notification through FoodTrader. Please ensure that you contact Environmental Health Services on 9747 7200 prior to submitting this form to Council
- Proof of organisation being registered as a charity with the Australian Charities and Not-for-Profits Commission (ACNC)

Heavy Vehicle
Council’s General Local Laws 2015 (Part 5, Clause 67) requires a property owner or occupier to obtain a permit if they are seeking to store, park or repair any vehicle weighing over 4.5 tonnes on a property in a residential area.
This assists in keeping residential streets free from heavy vehicle traffic, and compliance with the Road Safety Road Rules 2017 (VIC) requirement that Heavy Vehicles are not stopped longer than 1 hour on a length of road, in a built-up area.
A heavy vehicle must not be kept or parked on the property until a permit has been approved.

Mobile Food Vehicles / Roadside Trading
Council’s General Local Law requires a permit to place a mobile food vehicle on Council land.
The Mobile Food Vehicle (MFV) Policy has been developed to support the operations of MFVs within the municipality and to provide a framework for both Council staff and mobile food vehicle operators in relation to obtaining a permit for operation, as well as the ongoing management of Council approved sites.

Council allocates permits on an annual basis for a twelve-month period and will be available at the following designated locations:
- Navan Park - Centenary Ave Melton
- Hannah Watts Park - High Street Melton
- Taylors Hill Community Centre - Calder Park Drive Taylors Hill (From October to March only)
- Bridge Road Play Space/Atherstone Athletics Facility – Bridge Rd, Cobblebank
- Frontier Park/Woodlea Oval – Frontier Av, Aintree
- Wiltshire Park – Wiltshire Blvd, Thornhill Park
- Burnside Heights Recreation Reserve – Tenterfield Dr, Burnside Heights
- Eynesbury Recreation Reserve – Avoca St, Eynesbury
- Diggers Rest Recreation Reserve – Plumpton Rd, Diggers Rest
- Scott St Park/Reserve – Cnr Scott St & Plover St, Melton
- Exford Rd North BioDiversity Reserve Car Park – In front of 1221 Exford Rd, Exford
- Melton Botanical Gardens – Lakewood Blvd, Melton
Council offers 3 session times each day, as follows:
- 6am - 11am
- 11am - 4.30pm
- 4.30pm – 10pm
If you would like to trade at several different locations, you would need to submit separate application forms. Please be advised all permits expire on 30 June every year and need to be renewed annually.
If you wish to obtain a permit, the application will be through Service Victoria and will then be provided to Council for processing. Permit conditions include restrictions around the following:
- Obstructions of any footpaths, roads, sightlines or pedestrian/vehicle traffic
- Patron behaviour, noise, odour, lighting and disposal of litter
- Location of vehicle placement
- Street furniture or additional promotional signage may not be placed at the location in relation to the MFV

- Registration with Foodtrader under the Food Act 1984
- Public Liability Insurance with a minimum of $20,000,000 coverage per occurrence

Radio Control
Council’s General Local Laws 2015 (Part 3, Clause 42) requires a person to obtain a permit if they want to control any radio control model or vehicle on Council Reserves (excluding drones).
If you are applying for a permit, please submit the application 10 business days prior to commencing activity.
Permit conditions may include restrictions around the following:
- Damage caused to Council Assets
- Impact on other residents, in relation to noise, proximity and effect to the amenity of the area
- Hours of use

- A permit will be valid for 12 months upon being issued
- Please include a photograph and any further specifications of your radio control model or vehicle with this application
- You must hold Public Liability Insurance with a minimum of $20 million that has a Principles Indemnity Clause to receive a permit

Real Estate Pointer Boards
Council’s General Local Laws 2015 (Part 3, Clause 28) requires a person or business to obtain a permit if they are seeking to place out a Real Estate Pointer Board on a road, road related area or in a public place.
Please complete an online Application form 10 business days prior to the commencement of the proposed activity. Real Estate Pointer Board Permits expire on 30 June every year.
Permit conditions may include restrictions around the following:
- Timeframes of placement
- Obstruction or obstructing views of pedestrians or vehicles
- Location of placement of signage
- Damage caused to Council Assets
- Details required on signage
- Size, make and condition of signage

Shipping Container or Portable Self Storage Container
Council’s General Local Laws 2015 (Part 5, Clause 65 and Clause 66) requires a property owner to obtain a permit if they are seeking to keep, store, repair any shipping container on residential land.
You must confirm that a planning permit is not required, prior to applying for a Local Laws permit. Contact our Planning team for more information on 9747 7200.
Please note, it is not permitted to place shipping containers on any Council land or road.
Permit conditions may include restrictions around the following:
- Placement of shipping container
- Obstructions or obscuring views
- Condition of the shipping container

Unregistered Vehicle
Council’s General Local Laws 2015, Part 5, Clause 68 (C), requires a property owner or occupier to obtain a permit if they are seeking to store more than 1 unregistered vehicle on residential land in a manner that is unsightly or detrimental to the amenity of the area.
Upon approval of a permit, the holder must ensure the following:
- Any more than 1 unregistered vehicle stored in the front yard of the property are to be covered by a car cover or similar, and to be secured to the vehicle. Alternatively, they must not be visible from the street
- Any grass area surrounding the vehicles must be maintained so the property has no negative impact to the street scape or attract vermin
- Any vehicles in the front yard of the property must not be dismantled or broken up
- The vehicles must not overhang the property boundary or obstruct or be stopped on any part of the footpath, naturestrip or road
- The vehicles must not be repaired on the road or naturestrip
- No parts, equipment or materials from the vehicles may be placed or stored in the front yard of the property or in the street

Any other use of Council Land may require a permit.
